Regulatory Background

California Insurance Bulletin 2022-08, explained.

The October 2022 CDI regulatory bulletin that reshaped the California wildfire insurance discount landscape. The Safer From Wildfires framework, the carrier obligations, and how to actually claim the discount.

What the bulletin actually did

California Insurance Bulletin 2022-08 was issued by Insurance Commissioner Ricardo Lara on October 17, 2022, in response to a multi-year contraction of the California homeowners insurance market driven by wildfire losses. The bulletin established two coordinated requirements for admitted carriers writing residential property coverage in California:

  1. Mandatory mitigation discounts. Every carrier must offer premium discounts to policyholders who complete specific wildfire mitigation actions.
  2. Rate filing reflection. Each carrier's next rate filing must explicitly incorporate the mitigation discount structure and demonstrate the actuarial basis for the discount levels offered.

The bulletin operates under the authority of California Insurance Code §10089.4 (which addresses risk-based pricing in residential insurance) and §1861.05 (which requires rates to be approved by the Commissioner as not excessive, inadequate, or unfairly discriminatory).

The Safer From Wildfires framework

Implementing the bulletin requires a common standard for what mitigation actions qualify for the discount. CDI produced this in coordination with CAL FIRE and the California Governor's Office of Emergency Services (CalOES) under the brand name Safer From Wildfires. The framework defines mitigation actions in three categories:

1. Structure (home hardening)

  • Class A fire-rated roof assembly
  • Ember-resistant attic, eave, and foundation vents
  • Cleared gutters and roof debris
  • Ember-resistant deck materials and undeck enclosure
  • Non-combustible siding (fiber cement, stucco, metal)
  • Dual-pane tempered glass windows
  • Enclosed eaves (box eaves)
  • Garage door perimeter sealing

2. Defensible space (perimeter)

  • Zone 0 compliance — the 5-foot ember-resistant perimeter under AB 3074
  • Zone 1 compliance — 5–30 ft, lean, clean, and green
  • Zone 2 compliance — 30–100 ft, reduced fuel
  • No combustible storage within 30 feet of structures
  • Documented annual maintenance

3. Community-level mitigation

  • Firewise USA community participation
  • Local fire-safe council membership or recognized community program
  • County-level wildfire mitigation programs (vary by jurisdiction)

How carriers implement the discount

Each carrier's discount structure is its own — the bulletin requires discounts but does not prescribe specific percentages. Common patterns observed in California carrier filings 2024–2026:

  • Tier-based discounts. Bronze, Silver, and Gold tiers (or equivalent) based on the accumulated mitigation actions completed. Bronze: 5–10% off baseline; Silver: 10–15%; Gold: 15–25%.
  • Per-action discounts. Specific discount amounts for specific actions (e.g., 2% for 1/8" vent mesh, 3% for Class A roof). Carrier applies the sum of completed actions.
  • Certification-based discounts. Significant discount (10–20%) for documented IBHS Wildfire Prepared Home certification, which combines multiple Safer From Wildfires actions into a single formal certification.

Documentation requirements

To claim the discount, carriers typically require:

  • Photographic evidence of each mitigation action, dated and labeled
  • Itemized invoices for any contractor work, with the work described against the Safer From Wildfires action being credited
  • Inspection report from a qualified inspector — CAL FIRE defensible space inspection report, private defensible space inspector, or IBHS Wildfire Prepared Home certification
  • Manufacturer product listings for any Chapter 7A-listed building products (vents, decking, etc.)

Some carriers conduct their own verification (aerial imagery, occasionally in-person inspector); others rely on the homeowner's submitted documentation.

The FAIR Plan and 2022-08

The California FAIR Plan offers its own mitigation discount structure aligned with the Safer From Wildfires framework. The FAIR Plan discount percentages are typically smaller than what major admitted carriers offer (because the FAIR Plan's baseline is already structured around higher-risk properties), but they are still meaningful — typically 15–25% off baseline for full Safer From Wildfires compliance.

What it means practically

The bulletin shifted the California insurance market toward a structure where documented mitigation is actively rewarded with measurable premium reduction. For homeowners completing Zone 0 and home hardening work, the discount value over the life of the property typically substantially exceeds the cost of the work — particularly when combined with re-entry from FAIR Plan to standard coverage.

Frequently asked questions

What is Insurance Bulletin 2022-08?
A regulatory bulletin issued by the California Department of Insurance in October 2022 (Bulletin 2022-08) that required admitted insurance carriers writing homeowners coverage in California to submit rate filings reflecting wildfire mitigation actions taken by homeowners, and to offer specific discounts for documented mitigation work. The bulletin operates under the framework of California Insurance Code §10089.4 and was issued in response to the 2017-2022 wildfire-driven insurance market crisis.
Is the mitigation discount mandatory for carriers?
Yes. Carriers writing homeowners coverage in California must offer mitigation discounts as part of their CDI-approved rate filings. The specific discount levels and the mitigation actions credited can vary by carrier, but the obligation to provide discounts for documented mitigation work is universal under 2022-08.
What is the Safer From Wildfires framework?
A standardized list of mitigation actions developed by CDI in coordination with CAL FIRE and CalOES that defines what carriers must consider for discount eligibility. The framework covers home hardening (roofing, vents, gutters, deck), defensible space (Zones 0, 1, 2), and community-level mitigation (Firewise USA participation, county-level programs). Carriers must reference the Safer From Wildfires actions in their rate filings.
How do I claim the discount?
Contact your carrier (or your broker) and document the specific mitigation actions completed. Most carriers require photographic documentation, dated invoices for any contractor work, and often an inspection report. Some carriers will conduct their own verification; others rely on homeowner attestation. The discount typically applies at the next renewal cycle after documentation is accepted.
